Estate Planning
Often the general public is misled into believing that a "trust" is a must for everyone and is critical to saving your family taxes, probate and additional heartache after your death. It is true that a trust can provide excellent benefits, however, a trust is only required in particular situations. A will is still an effective tool and can serve everyone, even to the point they don't need a trust. Generally, the triggering events that will create a need for a trust is owning two or more pieces of real property, having an estate worth more than 1.5 million dollars (including life insurance) or having a situation of a second marriage.
All Estate Plans designed at KKO include the following:
- Living Will - This document sets forth your wishes as to whether or not you desire to remain on artificial life support in the event of terminal injury or illness.
- Durable Power of Attorney for Health Care - This document gives another person the authority to make health care decisions for you in the event you are unable to do yourself. This is a crucial document and works "hand in hand" with the Living Will.
- Durable Power of Attorney for Finances - This document gives another person the authority to manage your financial affairs in the event of incapacity. This is an important instrument in order to have another manage a trust or transfer property.
- Memorandum for Specific Devisees - This statement allows you to identify specific pieces of property and who will receive the items of sentimental value upon your death. Taking the steps to implement this document makes it easier for family members after your death and avoids arguments over the division of items such as photo albums, jewelry, family heirlooms, etc.
- Final Instructions - We often suggest that our client take the time to write some thoughts and advice to loved ones that can be read by the family after their passing.
- Location of Important Documents and Family Records - This is a statement which helps you set forth and keep a detailed record of the location of important documents (bank accounts, stocks, bonds, safe deposit box, etc.). This is extremely helpful to your Trustee or Personal Representative of your Estate in locating your assets and helps maintain your holdings and prevent loss due to confusion and misinformation.
- Funeral and Burial Instructions - We also encourage our clients to write down specific instructions as to where and how they are to be buried and also who they may desire to handle funeral arrangements and suggested speakers, musical numbers, activities, etc.
